OFFICIAL RULES

NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY. A PURCHASE OR PAYMENT OF MONEY WILL NOT IMPROVE THE CHANCES OF WINNING. 

The “Four Sixes® Ranch Brand Beef Social Giveaway” (the “Giveaway”) is intended for legal residents of the 48 contiguous states of the United States (void in Hawaii, Alaska, Puerto Rico, all US territories and possessions and all overseas military installations) (“Participating States”). The Giveaway shall only be construed and evaluated according to USA law and applicable state law. Do not enter this Giveaway if you are not a resident of the Participating States or otherwise ineligible in accordance with these Official Rules at the time of entry. The Giveaway is sponsored by 6666 Brand, LLC with address at P.O. Box 177, Guthrie, Texas 79236. (the “Sponsor”). 

 

ELIGIBILITY: The Giveaway is open to legal residents of Participating States who are at least eighteen (18) years of age or the age of majority, whichever is older, in their respective state of permanent residence at the time of entry (the “Entrants”). The Sponsor’s employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives and advertising and promotional agencies, and members of their immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate in this Giveaway. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Void where prohibited or restricted by law. (For the avoidance of doubt, any references in these Official Rules to Entrants shall also include the Entrants who are deemed the Winners (as defined below).)

 

AGREEMENT TO OFFICIAL RULES: By participating, Entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Giveaway. Winning a Prize (as defined below) is contingent upon completing all requirements set forth herein.

 

HOW TO ENTER: The Giveaway begins at 12:00:01 a.m. EST on February 17, 2025, and ends at 11:59:59 p.m. EST on February 20, 2025 (“Giveaway Period”). The Sponsor’s database computer is the official time-keeping device for the Giveaway.

 

The method of entry is as follows:

1.    Social Step: During the Giveaway Period, Entrants can enter the Giveaway by completing the following steps on our Instagram page. (the “Social Entry”). The Entrants must

a.     Follow @6666ranchbeef on Instagram

b.     Like the Giveaway post

2.     Email Step: Next, Entrants must subscribe to Four Sixes® Ranch Brand Beef Email program. Entrants must understand with subscribing to email, they have agreed to opt-in to receive emails from brand. Entrants must subscribe for email on website at https://6666steak.com/

3.     Tag a friend in Giveaway post comments to receive 1 BONUS entry.

 

By completing the Giveaway entry rules, all elements of Social Entry and Email Entry, the Entrant will receive one (1) Giveaway entry. Those that tag a friend in Giveaway post comments will receive an additional (1) Giveaway entry. Entrants understand and agree that their Instagram handles will be shared in our stories to announce winners to all participants. 

DRAWING AND NOTIFICATION: The potential prize winners (the “Winner”) will be selected in random drawings. The prize drawings will be conducted by the Sponsors, whose decisions are final and binding. There will be two (2) random drawings amongst qualified entrants and two (2) Winners. The prize drawings will be conducted on Friday, February 21st or within 24 hours following Entry Period. The potential Winners will be contacted by the Sponsor via Instargam DM to verify email & winning acceptance. Odds of winning a prize will depend on the total number of eligible entries received throughout Entry Period. An Entrant is not a Winner of any prize, even if notified of being a Winner or issued any item of value, unless and until Entrant's eligibility has been, and continues to be verified to the satisfaction of Sponsor, and Entrant has complied with all other requirements in these Official Rules.

PRIZES & PRIZE CONDITIONS: There will be two (2) individual prizes available for two (2) individual Winners. Each prize Winner, upon the Sponsors’ verification of eligibility, will receive two (2) 6666 Ranch Cowhide Pillows ($500) and one (1) Four Sixes® Ranch Brand Beef Reserve Ranch Sampler ($128) (“Prize”).

 

Reserve Ranch Sampler includes;  1x Reserve Ribeye Steak (14 oz), 1x Reserve Striploin Steak (12 oz), 1x Reserve Tenderloin Steaks (two 5 oz steaks), 1x Ground Prime Rib Beef (1 lb).

 

The total value for each Prize is $628.00.  NOTE: Substitution, assignment or transfer of a Prize is not permitted, except by Sponsor, who reserves the right to substitute the Prize with another of equal or greater value. All other expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Winners. 

By accepting the Prize, the Winners agree to release and hold harmless the Released Parties (as defined below) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of the Prize. The Winners will be responsible for all local, state, and federal taxes associated with the receipt, if any, of the Prize. It is the sole responsibility of the Winner to seek independent counsel regarding personal tax implications, if any.  The Winners are solely responsible for all matters relating to the Prize after it is awarded and shipped to Winner. If a Prize or Prize notification is returned as unclaimed or undeliverable to the potential Winner, if a potential Winner cannot be reached or does not comply with notification instructions within three (3) business days from the first notification attempt, if a potential Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected.

 

The Sponsor is in no way responsible for any cancellations, delays, postponements, diversions, substitutions, theft, misplacement, changes in service or any other act or omission, or result thereof, caused by any third party.  In the event that any error, mistake, failure, or discrepancy causes more than the stated number of Prizes as set forth in these Official Rules to be promoted, noticed or claimed, Sponsor may award only the stated number of prizes by conducting a random drawing from among all legitimate, unawarded, eligible Prize claims.

 

By accepting the Prize, where permitted by law, the Winners grant to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to broadcast via worldwide Instagram or social story posting of Winner’s Instagram handle, and without review, approval or notification. The Winners also acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize.

Review Guidelines: 

The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void. Released Parties (as defined below) are not responsible for late, incomplete, delayed, undelivered, or misdirected entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. All information submitted by Entrants will be treated according to Sponsor’s Privacy Policy, available at https://6666steak.com/policies/privacy-policy. By participating in the Giveaway and providing any personal contact information, such as shipping address and confirmation of email, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

 

Sponsor may collect and process Entrants' personal contact information in connection with the Giveaway for the purposes of delivering Prize. This process is in order to fulfill a contract or take steps linked to a contract (including these Official Rules), and if such processing is not provided, Entrant may not be able to enter into, and Sponsor may not be able to fulfill, the contract.  Sponsor will retain the personal contact information that Entrant provides in connection with the Giveaway for a period reasonably necessary for the purpose of administering and managing the Giveaway, including prize fulfillment. Sponsor may disclose Instagram handle with a public to announce the Winner. Notwithstanding the foregoing, any related personal contact information submitted by an Entrant may be maintained on Sponsor’s and/or its affiliates’ websites for such period of time as determined by Sponsor, in its sole discretion and in accordance with Sponsor’s Privacy Policy.

 

By submitting any Entry, Entrants represent that (a) the Entry is truthful, original, and does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, and does not violate any applicable federal, state or local laws or ordinances, (b) Entrant owns the rights to use and allow the use of the Entry, and (c) Entrant has not copied or in any way taken any of the Entry from any third party.

GENERAL CONDITIONS: Sponsor reserves the right to cancel or modify the Giveaway if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Giveaway is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Giveaway, Entrants agree to release and hold harmless the Sponsor, and each of their respective parent and affiliate companies and each of their vendors, suppliers, consultants, sub-contractors, distributors, legal counsel and advertising, marketing, public relations and promotional/fulfillment agencies, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any Prize, including, but not limited to: (i) any technical errors that may prevent an Entrant from submitting an entry; (ii) unauthorized human intervention in the Giveaway; (iii) printing errors; (iv) errors in the administration of the Giveaway or the processing of entries; or (v) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Giveaway or receipt of any Prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Giveaway or downloading any materials in this Giveaway. Entrants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Released Parties be liable for attorney fees. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. For New Jersey Residents: nothing herein bars recovery of damages or attorneys’ fees where mandated by statute.

 

Except as expressly provided above, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS GIVEAWAY OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.

 

By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Giveaway or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of a Prize. Released Parties are not liable in the event that any portion of the Giveaway is cancelled due to weather, fire, strike, acts of war or terrorism, pandemic, or any other condition beyond their control.

 

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE USA ARE HEREBY EXPRESSLY WAIVED BY HIM/HER.  SECTION 1542 READS AS FOLLOWS:

“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

 

DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants and Sponsor in connection with the Giveaway shall be governed by and construed in accordance with the laws of the State of Kansas, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws. By participating in the Giveaway, Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Giveaway, shall be resolved individually without resort to any form of class action; (ii) any judicial proceeding shall take place in a federal or state court located in Kansas; (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event will attorney fees be awarded or recoverable; (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (v) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief. 

SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein. 

MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Giveaway and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. In the event of an inconsistency between these Official Rules and any disclosure or other statement contained in any Giveaway-related materials, including without limitation, an entry form or any point-of-sale, radio, television, print, or online advertising, these Official Rules will prevail and govern. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by Sponsor. The waiver by of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by the Entrants, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor and Entrant.
